Keeping It Legal:
The New Rules of Digital Media
This month, we will discuss the emerging and outstanding
legal issues created by the growth of digital media and the ways
entrepreneurs and leaders of digital media businesses can and should
prepare to handle them.
The transition from hard-copy objects
like vinyl records to digitized bits of information like MP3s has
prompted an upheaval of business models, the law, government policy,
and social practices associated with the use, distribution, and control
of digital media. The dramatic expansion of this new media segment has
created a legal minefield related to issues such as intellectual
property protection and infringement, user generated content and user
interaction, online safety and privacy, advergaming and virtual
currencies.
Lawyers, policymakers, and industry leaders, are
scrambling to understand and set guidelines for the every changing
issues that are the nexus where business, technology and law meet.
Their actions and decisions will have long-term impact on not just
digital media law, but the entire digital media industry. Leaders of
digital media companies need to understand and prepare to handle these
legal challenges.

After graduating from NYU in
2005, Fred interned at Creative Commons in San Francisco and then moved
back to NYC to stage the first-of-their-kind DRM protests, as well as
organize several other related public events, all receiving national
media attention. Since the summer of 2006 Fred has been the Creative
Commons Cultural Fellow and has worked with organizations, schools, and
major art institutions in New York to help shape their copyright
policies through the use of Creative Commons licenses.

Ian assists both emerging and
established companies in generating revenue and gaining a competitive
advantage from their technologies. He advises clients on all aspects of
intellectual property and Internet law, including complex corporate
transactions and protecting, licensing and enforcing intellectual
property rights. Mr. DiBernardo's transactional practice includes
mergers and acquisitions, securities and corporate finance, joint
ventures and general licensing and counseling. In this regard, he
frequently collaborates with Stroock’s corporate, financial
restructuring, insurance and tax attorneys.

Melinda began her career in
private law practice before joining MTV Networks in a position
concentrating on international and new media businesses. In 2007, she
joined the peer to peer video company Joost as the Head of Content
Management and Strategy. Lee left this role in 2008 to concentrate
full-time on her own start-up Uncensored Interview, a content production and licensing company, which produces
free-format style interviews with musicians of all genres and licenses
high-definition quality footage to partner companies. UI has created
distribution relationships with all areas of the music and digital
industry and has been recognized for many awards including the SXSW
Interactive Web Awards and the Webby Awards.

Robert Rosenberg
SVP/Counsel: Digital Media
Sales & Marketing
Robert Rosenberg is Senior Vice President, Counsel, Digital Media,
Sales & Marketing in Showtime Networks’ New York office, where he
gets involved in most transactional aspects of Showtime Networks’
business, with a special concentration in the areas of technology and
digital distribution. Before joining Showtime Networks in February
2001, Mr. Rosenberg worked as an associate with the law firm of Willkie
Farr & Gallagher where he was involved in intellectual property and
technology-based corporate transactions. Prior to becoming an attorney,
Mr. Rosenberg was an Account Supervisor with the Ogilvy & Mather
advertising agency. He graduated from Cornell University with a
Bachelor of Science in Communications and received his Juris Doctorate
from Brooklyn Law School.

Limor brings her extensive
experience to bear on behalf of technology companies interested in
introducing new products to the marketplace or repositioning existing
products into new marketplaces. The technology arena offers Limor a
spectrum of opportunity to employ her business philosophies: listen
closely to the market, develop solution based products and services,
and then utilize market directed communication tools to open doors and
close sales. Through this process, Limor helps clients set the
foundation for their success and then works with them achieve it.
A
graduate of the University of Pennsylvania, BA and Boston University
School of Law, JD, she is a member of the California, New York and
Massachusetts state bars. She is also an alumna of the Anderson School,
UCLA Executive Program for Business Management.
